The basis for determining a refugee status is according to the United Nation's definition which is: Any person who has left his or her country of origin and is afraid to return due to a fear of persecution. The persecution would be due to their race, nationality, religion or membership in a social group, or due to their political opinions. There are many factors involved in the decision process for this type of visa. Some of which are outside our control (like quotas set each year by the Australian government on numbers of refugees it will accept). Other considerations involved in the process are the seriousness of the risk should the person be forced to return to his or her home country, whether or not the person has any relations already living in Australia and whether or not the person's country of origin has procedures in place already, that could be used to guarantee the person's safety on their return. Persecution and discrimination are also defined for clarity by the United Nations. Persecution being threats to life or freedom, confiscation of personal possessions or re-education operations. And discrimination being: Not allowed to make a living or partake in education, abuse of one's privacy or denial of the basic rights allowed to other citizens.
